Gqeberha lawyer accused of lying to a client and pocketing over R30,000

Gqeberha lawyer Du-Wayne Stoltz has found himself in hot water once again, this time for allegedly fabricating a court order, lying about communication with the sheriff’s office, and falsifying a proof of payment.

These alleged actions have cost a Nelson Mandela Bay pharmacist over R30,000.

Stoltz, who was suspended from practising by the Legal Practice Council (LPC) three months ago, has denied any wrongdoing.

However, the LPC is currently investigating the allegations and has encouraged the victim, Johann Cloete, to report a case of fraud to the police.

This is not the first time Stoltz has been in the spotlight for questionable practices.

In December, he allegedly fabricated a court judgment to line his own pockets, despite being fully aware that he was not allowed to practise law at the time. As a result, the LPC is now seeking to permanently strike him from the roll.

Cloete, who had previously hired Stoltz to represent him in a case against the Eastern Cape health department, claims he was duped out of more than R30,000.

Stoltz informed Cloete that the department still owed him R600,000, citing a salary increment and interest on the amount.

He then allegedly asked Cloete to transfer R27,500 for the advocate’s fees, promising that it would be reimbursed once the case was settled in the labour court.
