Senzo Mayiwa trial postponed due to jurisdiction argument
Advocate Malesela Teffo’s request is allowed for him to prepare his arguments. He believes that the Senzo Meyiwa murder trial should be held in the South Gauteng High Court in Johannesburg. Rather than in North Gauteng High Court in Tshwane. The trail is presently held in Tshwane.
Four of the five persons were accused of killing Senzo Mayiwa. The former Bafana Bafana and Orlando Pirates goalie murder accused are represented by Teffo. As a result, he will now be able to file an official complaint about the situation.
Judge Tshifhiwa Maumela granted Teffo’s request. It is for a hearing on the jurisdictional problems. Senzo Mayiwa was killed In 2014, at the time he was visiting his then-girlfriend, Khumalo, in Vosloorus.
Teffo stated that the five-day period will begin on 17 June 2022. He plans to launch his application by 23 June 2022.
On 12 July 2023 oral arguments on Teffo’s legal application will be heard.
The suggestion
Earlier, a letter signed by the Director of Public Prosecutions (DPP), Gauteng Local Division was provided as a confirmation. He is distancing himself from a suggestion to prosecute the people who were in the residence with Meyiwa, including Khumalo.
A suggestion by the State to charge Kelly Khumalo, Longwe Twala, Gladness Khumalo, Zandie Khumalo, Tumelo Madlala, Mthokozisi Thwala, and Maggie Phiri is contained in the second docket, referred to as docket 375.
Mshololo submitted a request for clarity from the National Prosecuting Authority (NPA) on the status of the second docket before the meeting adjourned.
“I’m requesting an order instructing the (NPA head in Gauteng) to clarify the opinion of the junior advocate.” And as the head of the office, (Andrew Chauke) to divulge whether a decision has been reached on (prosecuting) the second docket.”
Mshololo wants to know if the people mentioned in the second docket would be asked to appear as suspect witnesses or accused witnesses.
